Gómez-Strozzi Quoted in El Financiero About the Private Initiative in the Energy Sector
Foley & Lardner LLP Partner Alejandro Gómez-Strozzi was quoted in the El Financiero article, “IP asks Mexico to ‘make peace’ with the U.S. and Canada,” about the private initiative and its position to avoid disputes with the trade partners of the Treaty between Mexico, the United States, and Canada (T-MEC) in the energy sector. The article reports that a request for consultations on this issue is an opportunity to reassess the actions of the Mexican government and avoid alienating investment in the entire value chain.
Gómez-Strozzi pointed out that, although it remains to be known what specific issues the United States will request the start of consultations between governments be, this does not mean that all cases lead to a dispute resolution panel.
“In parallel with the State-State mechanism, private investors can also take Mexico, each one for its part under the Investor-State mechanism, to international arbitrations when considering and demonstrating that their rights were violated under the T-MEC, which can also become important legal battles,” he said.
