Foley & Lardner LLP Partner Christopher Swift is quoted in the IFLR article, “Market should stand ready for reverse CFIUS,” discussing the U.S. government’s likely impending implementation of the reverse Committee on Foreign Investment in the United States regime (CFIUS).
“The easiest way to understand what the Biden administration is likely to have on its priority list for outbound investment is to look at what it is worried about when it comes to inbound investment: that is to say, certain categories of technology, certain infrastructure issues, and certain data and privacy issues,” said Swift.
“Similarly to investments in Russia, with China, there are five key questions to ask before starting to build a relationship: who is the investment target or your business partner, what do they do for a living, where are they located, why do they need your investment, and how much oversight and control will I have in the country of investment,” explained Swift.
