Foley & Lardner LLP partner Lynn Gandhi is quoted in the Law360 article, “Mich. Biz Groups, Lawmakers File Suit To Cement Tax Cut,” commenting on a lawsuit underway in Michigan to prevent state officials from reversing an income tax cut next year.
“As discourse between parties is at a long-time low,” Gandhi explained, “judicial review becomes the option. Gandhi said that if the court determines the language of the rate cut is unclear, state precedent would compel the court to lean toward ruling for the taxpayers.
“When it comes to tax statutes, the ambiguity should be resolved in favor of the taxpayer because they are the party to whom the deprivation is occurring,” she added.
