Foley & Lardner LLP partner Donald Schroeder discussed a recently passed Massachusetts ballot initiative impacting ride-hailing services in the Law360 article, “Mass. Voters Back Gig Driver Unions, Setting Up Possible Suit.”
Schroeder said he expects it to take years before the dust settles on the unionization measure for two reasons. First, the measure provides a clear path for unions to win representation of drivers, and second, it creates a complex, sector-based bargaining system. He commented that it would not surprise him if a legal challenge to the measure reaches the First Circuit or U.S. Supreme Court.
“We’ll be talking about this for a couple of years at a minimum,” Schroeder added.
