Gregory Husisian Quoted on Tariff Refund Process Ahead of SCOTUS Trade Case
Foley & Lardner LLP partner Gregory Husisian shared insight on how a possible tariff refund process could play out in the SupplyChainDive article, “What shippers need to know about potential tariff refunds.”
With the U.S. Supreme Court set to hear oral arguments on November 5, 2025, on whether the Trump administration’s use of the International Emergency Economic Powers Act to impose tariffs is lawful, Husisian explained how an automatic tariff refund process may play out should the court rule against the administration.
He shared that an automatic process is possible as most customs entries are filed electronically, creating a simpler means of verifying information. Husisian added that he anticipates U.S. Customs and Border Protection to provide guidance to importers regarding refund procedures, should they become necessary.
