Charles Gass Quoted on Health Care Implications of Colorado AI Act
Foley & Lardner LLP senior counsel Charles Gass detailed Colorado’s Artificial Intelligence Act and its implications for health providers in the ColoradoBiz article, “Colorado leads nation on AI healthcare regulations.”
Colorado’s Artificial Intelligence Act, scheduled to take effect on June 30, 2026, will require health care providers using AI systems to comply with new governance and disclosure obligations.
In a February 2025 Foley Health Care Law Today article cited by ColoradoBiz, Gass shared that the Colorado AI law “primarily seeks to mitigate algorithmic discrimination, defined as AI-driven decision-making that results in unlawful differential treatment or disparate impact based on race, disability, age or language proficiency.”
“AI is going to be used and in some cases without patients’ permission,” he cautioned. “Patients should ask whether their provider is using AI to assist administratively or clinically.”
Gass also explored potential algorithmic bias in AI diagnostics and scheduling, citing how certain clinical conditions can manifest uniquely across different demographic groups. He added that providers should make sure they remain “in the driver’s seat for patient care.”
