Ward commented on the U.S. Supreme Court declining review of an Eighth Circuit decision upholding Minnesota’s captive‑audience law, stating that as more challenges continue to develop, the court may step in, though it is likely mindful of the issue’s political sensitivity and the uncertainty surrounding the National Labor Relations Board’s actions.
“I think if they really wanted to take it up, then they would have not worried about the standing issue,” Ward explained. “That may be a sort of easy way to say we don’t want to deal with this right now because it’s really a hot-button political issue.”
