Foley & Lardner LLP partner Kyle Faget and Jami Gekas authored the article “Federal Trade Commission Workshop Addresses Healthcare Provider Deceptive Trade Practices in Provision of Gender-Affirming Care (GAC),” for the November – December 2025 issue of Journal of Health Care Compliance.
Faget and Gekas examine how health care providers, clinics, and drug manufacturers could face civil, criminal, and regulatory actions under expansive consumer protection interpretations for their role in offering or promoting GAC to minors.
“Although the Federal Trade Commission is soliciting feedback on this issue, stakeholders in the health care space should be aware of potential enforcement actions and class actions in the future,” the authors conclude.
