Attorneys in Foley’s telemedicine practice, including partner Nathaniel Lacktman, contributed comments to the proposed telemedicine regulations issued by the North Dakota Board of Medicine. The Board held a public hearing on the proposed regulations in September and solicited comments, all of which will be discussed and reviewed at the Board’s November 20 meeting. The last time the Board issued guidance on telemedicine was March 2014.
The comments praised the North Dakota Board for promulgating telemedicine rules designed to protect patient care while allowing for health innovation and development. The comments also offered suggestions on technical drafting of the language regarding physician assistants in cross-border telemedicine arrangements.
