Foley Partner Philip Phillips was quoted in an article that appeared in Michigan Lawyers Weekly on June 21, 2010 titled “Case weighs heavy on ‘scales’ of justice.” Phillips discusses a lawsuit brought against the Hooters restaurant chain by a former employee who claims to have faced weight discrimination. He states that the case will boil down to Hooters’ ability to prove that Hooters Girls are entertainers rather than waitresses, adding that the question will be whether aesthetics are essential to the restaurant chain’s business model.
