- Direct Store Delivery (DSD): Independent Contracting Under Siege
Foley Labor & Employment Practice and Food Industry Team Partner John H. Douglas will discuss recent developments in independent contracting, including the wave of litigation spreading across the country challenging longstanding independent contractor practices in DSD.
- California Proposition 65: Highlights for the Food Industry
California, the largest U.S. consumer market, requires warning labels on products sold in the state which contain trace amounts of chemicals known to cause cancer or reproductive harm. Foley Partner S. Wayne Rosenbaum will explain the basics of California’s Proposition 65 and how food processors, distributors, and retailers are affected. Additionally, we will provide an update on recent listings, regulations, and litigation impacting the food industry.
- The EU Nutrition and Health Claims Regulation Starts to Bite — Practical Impact
Eversheds Food & Drink Sector Partner Owen Warnock and Associate Katharine Vickery will summarize the new common European rules on nutrition and health claims, including the new labeling requirements and the process under way to to determine which health claims will be permitted in the future. Since food companies to date have had had much more freedom to make health claims in the EU, they will outline the transitional rules and discuss what a food business can do if a claim on which their product depends is banned.

GRATs as an Estate Planning Tool for High‑Net‑Worth Individuals
The Federal gift and estate tax exemption (also known as the “basic exclusion amount”) increased to $15,000,000 per individual for calendar year 2026. Taxpayers whose assets are subject to gift or estate tax despite the increased exclusion amount still have tax planning strategies to consider. A grantor retained annuity trust, or GRAT, allows individuals to implement an estate tax planning strategy even if they have already used their basic exclusion amount.
