Foley Health Care Partners Nathaniel Lacktman, Chris Donovan, Jana Kolarik, and Roger Strode, will be presenters at the American Corporate Counsel (ACC) Annual Meeting in Phoenix on October 27-30, 2019.
 
Nathaniel’s presentation will be on Monday, October 28, and is titled, “Telemedicine and Telehealth: The Future is Now.” As costs increase and resources and locations needed to deliver quality health care continue to gain complexity, telemedicine and telehealth are rapidly emerging solutions showing promise as alternatives to traditional health care delivery. A 2018 survey of health care executives reveals almost 75 percent of organizations currently offer, or plan to offer, these services, whereas just three years ago, nearly 87 percent of health care organizations were unsure or skeptical of this technology. This intermediate/advanced session will provide an informative discussion regarding the evolution and provision of telemedicine health services, such as state licensure requirements for providers of these services; criteria for establishing practitioner–patient relationships via telehealth technologies; accepted modalities for delivery of telehealth services; coverage and reimbursement issues; CMS terminology and questions CMS still considering; other proposed “telehealth” services in physician fee schedule; and other pending telehealth legislation.
 
On Tuesday, October 29, Chris, Jana, and Roger will be panelists on “Anatomy of a Deal: Health Care Style,” and will be joined by Gabriel Holdsman (SVP and GC, PTC Therapeutics, Inc.), Kenny Johnson (Senior Corporate Counsel, Quest Diagnostics Incorporated), and Jason Stevens (VP and Deputy GC, WellStar Health System, Inc.). There’s an old adage, if you’ve done one health care deal you’ve done one health care deal. For non-healthcare specialists,  an initial entry into the healthcare eco- system can be quite a strange  experience. The normal rules of successor liability, assumption and allocation of risk, market terms and business agreements applicable outside of healthcare are either turned on their head or twisted in a novel direction. Couple unique healthcare laws and regulations, HIPAA and related laws which drive deal structure, risk allocation and key business terms with an evolving market focused on data, AI, telemedicine, payer provider convergence and other recent trends  and you have a recipe for a complex and sometimes conflicting array of laws and regulations to master in order to get a deal to completion. This limited-attendance, hands-on session is designed for healthcare lawyers – and non-healthcare transactional lawyers.  It will  present  a series of discussions combined with active roundtable audience participation and group work to analyze a hypothetical health-related transaction. You’ll learn the deal process from NDA to LOI to definitive agreement, hear due diligence approaches and alignment with pricing strategy, discuss key risk allocation, identify unique health care successor liability rules, and much, much more.
