Associate
Nicholas Benson is an associate and real estate lawyer with Foley & Lardner LLP. Nick represents clients in a variety of complex real estate matters, including purchase and sales, development, New Markets Tax Credit and traditional financings. He also counsels clients in connection with the real estate aspects of corporate mergers and acquisitions.
In addition to his traditional real estate practice, Nick has experience in real estate aspects of wind, solar and BESS energy projects, including working on-site control documents; addressing title, survey, and other development matters, and performing real estate diligence for tax equity investments.

- Represented a client in a $70,000,000 portfolio acquisition of multiple medical office buildings located throughout the United States.
- Represented a leading global bank in its $105,000,000 refinancing loan of a portfolio of 11 skilled nursing facilities located throughout the United States.
- Represented a national bank in its $135,000,000 syndicated construction loan to develop a cold storage facility located in Georgia.
- Represented a national bank in two separate syndicated loans to develop cold storage facilities located in Georgia and Indianapolis, aggregating $378,962,000 in construction financing.
- Represented a national bank in its $100,000,000 construction loan for the purpose of providing financing for the acquisition and construction of approximately 17 renewable compressed natural gas fueling stations located throughout the United States.
- Represented a lender in a $3,800,000 New Markets Tax Credit financing for the redevelopment of a commercial grocer.
- Represented a regional multi-family developer on the acquisition, development and financing of 237 luxury apartment homes.
Energy
- Represented a major U.S. financial institution on real estate diligence and related work in connection with its $79 million construction and term loan investment in a portfolio of solar projects located in New York and Massachusetts, aggregating over 61 MW of production capability.
- Represented a major European based renewable energy developer in its development and financing of a 100 MW solar project in Illinois with an approximated project value of $173,000,000.
- Represented a major European based renewable energy developer in its development and financing of a 240 MW solar project in Texas with an approximated project value of $332,000,000.
- Represented RWE AG (RWE), a leading renewable energy company, in its purchase agreement with Con Edison, Inc., for all shares in Con Edison Clean Energy Businesses, Inc. (CEB), a leading operator and developer of renewable energy projects in the U.S., for a purchase price based on an enterprise value of $6.8 billion.
- Represented a leading electric utility provider in its $150,000,000 acquisition of a 155 MW wind farm located in Oklahoma.

Foley represented subsidiaries of American Electric Power and PNM Resources in the agreement to sell their renewables joint venture, New Mexico Renewable Development, LLC, to Exus North America Holdings, LLC for approximately $230 million.
