Foley Partner Mark Thimke was quoted in an article titled “Melt Down: The Winds of Change Buffet Climate Change Policy” in the April 1, 2010 issue of InsideCounsel. Thimke discusses the SEC’s guidance on disclosure rules applied to business or legal developments with regards to the issue of climate change. He states that disclosure rules requiring companies to assess risks created by the physical impacts of climate change relates to the fact that insurance companies might face losses from climate change-related storms. Thimke adds that companies will have to make some assumptions in their statements in response to the disarrangement that exists in EPA regulation and climate change legislation.
