Bloomberg BNA covered a 5th Circuit ruling of in favor of Administrative Assistant Brenda Tolbert seeking $27,000 under her company's wealth accumulation plan, sponsored by RBC Capital Markets Corp., by convincing the U.S. Court of Appeals that the plan was governed by the federal benefits law.
Gardere Partner Joe B. Harrison, counsel for the employees praised the ruling, stating, "I believe that the real significance of this opinion is the clarity with which it teaches us that thousands of financial sector employees are entitled to ERISA protection, without requiring their employers to do anything more than what is required of other employers across America."
