Partner Bryan House was quoted in a Bloomberg BNA article, “With SEC on the Prowl, Companies Should Comprehensively Review Worker Pacts,” on March 20, 2015. The article discussed the Securities and Exchange Commission enforcement on whistleblower activity and the Dodd-Frank Wall Street Reform’s anti-retaliation provisions.
In response to anti-retaliation enforcement action, House was quoted saying, “I don’t think the SEC is looking to bring lots of standalone retaliation claims based on nitpicking language in somebody’s agreements, but certainly, you can easily imagine circumstances where it would be appropriate given the law and the SEC rules in the area. I think it would probably take pretty egregious circumstances, but I don’t doubt that they’re out there somewhere.”
