Foley Prevails in Obtaining Additional Injunctive Relief on Behalf of Client Select Specialty Hospital in Dispute against CHRISTUS Good Shepherd Medical Center

Foley Gardere lawyers representing Longview, Texas-based Select Specialty Hospital secured a second temporary injunction against CHRISTUS Good Shepherd Medical Center in an on-going dispute. GSMC was again ordered to continue to provide critical care services to long-term patients inside its hospital within a hospital.

Partner Ed Burbach filed suit on behalf of Select Specialty Hospital in June against GSMC claiming that the hospital was trying to coerce Foley client Select Specialty Hospital into ending its lease and forcing it out of the facility where the hospital had resided for 16 years by cutting off critical services to patients which GSMC is contractually obligated to provide. Select Specialty Hospital had renewed its lease through 2023.

Burbach originally secured a temporary restraining order and injunction in July against, GSMC, but a Sixth District Appellate Court in Texas reversed the order in October. This second temporary injunction replaces one that was dissolved by an appeals court last month on technical grounds. “Judge [Brad] Morin agreed with us that he still believes it is appropriate for a temporary injunction to be in place until the trial of the case to protect the patients at Select Specialty Hospital’s facility in Longview,” Burbach said.
