Judith Waltz Quoted on OIG Decertification of New York Medicaid Fraud Control Unit
Foley & Lardner LLP partner Judith Waltz was quoted in the Report on Medicare Compliance article, “OPPS Rule Proposes Targeted Reviews of PBDs, New Attestation, More EMTALA Oversight.”
Waltz highlighted the ongoing federal crackdown on Medicare and Medicaid fraud, which has triggered heightened scrutiny of several state Medicaid Fraud Control Units (MFCUs).
Waltz expressed surprise at the U.S. Department of Health and Human Services Office of Inspector General stripping funding from New York’s Medicaid Fraud Control Unit, noting the state “is considered a leader in compliance.”
Waltz said in the absence of federal funding for state MCFUs, states will have to pick up the slack. If they don’t, “the state’s Medicaid program expenditures are at risk.”
