Trey McDonald III and James Carlos McFall Discuss Challenges Facing Student-Athletes in Evolving NIL Era
Foley & Lardner LLP partners Trey McDonald III and James Carlos McFall were featured in the Law360’s article, “Young Athletes Are Wising Up, But Attys Say They’re Still Kids,” discussing the challenges facing college student-athletes in the evolving name, image, and likeness landscape.
On the role of family in navigating business decisions, McDonald noted, “if a parent oversteps, the players are not reluctant to call us on the side and say, ‘Hey, maybe I don’t think that’s best.’”
McFall added that athletes are making difficult decisions while also dealing with scrutiny. He stated, “I think what you are seeing are, in my opinion, some of the most impressive people [who] have ever existed and [who are] doing it with more eyes on them than anybody in world history has ever had, [while] having to navigate a legal landscape that is evolving rapidly.”
McDonald also noted that young athletes can face questionable business opportunities, emphasizing the importance of legal counsel.
