Foley & Lardner LLP partner Matthew Krueger was quoted in a recent Law360 article discussing a U.S. Supreme Court case that could shape how courts interpret federal sentencing guidelines.
Krueger said Beaird v. United States could have implications beyond criminal sentencing, noting that Justice Gorsuch is “looking to the next suit.” He added that the justice “doesn’t want this case to signal to lower courts or set precedent for the Supreme Court of agreeing with agencies in their assertions of express delegations to issue binding interpretations of statutes.”
