Christopher Ward Weighs In on Warehouse Worker Arbitration Exemption
Foley & Lardner LLP partner Christopher Ward is quoted in the Law360 article, “9th Circ. To Revisit Warehouse Worker Exemption Debate,” which analyzes upcoming Ninth Circuit oral arguments in Uwaoma v. OTS Solutions LLC et al.
Ward explained that the decision may come down to an analysis of “what the workers did in the warehouse, compared to what they did in Ortiz.” He noted that the court viewed what happened in Ortiz “as a continuous process of transportation because all the workers were doing with the goods is really moving them.”
Ward added that the companies in Uwaoma could make an argument similar to one advanced by food delivery platforms in other cases, highlighting that “the goods are really transformed at the restaurant, and therefore they’re no longer in interstate transportation.”
