Partner/Retired

William T. Ellis is a partner and intellectual property lawyer with Foley & Lardner LLP. His practice focuses on the representation of emerging and mainline technology companies. William is a member of the firm’s Electronics and International Practices.

He serves his clients as counsel in matters of intellectual property litigation, patent infringement and validity opinions; patent procurement in business method, e-commerce, software, telecommunication, semiconductor, electronic and mechanical technologies; and licensing of patents, trade secrets and trademarks.

William has set up patent positions for:

  • software companies
  • hardware companies
  • banking groups
  • e-commerce companies
  • consumer products companies

William has over 25 years of industry experience in intellectual property counsel. He was formerly Intellectual Property counsel at IBM where he held the dual role of IP counsel for the IBM global network telecommunication company and for several software companies wholly owned by IBM. William also served as IBM’s managing counsel in the areas of computer systems, semi-conductor chips, and circuitry and negotiated numerous patent licenses for IBM.

Before joining IBM, William was chief IP counsel at the Naval Research Laboratory, working in the areas of electronic circuitry, semiconductor devices, optical communications, new materials and coatings. He is a former USPTO patent examiner in the area of modulated carrier systems, radio and television.

IP担当の企業内弁護士として25年以上の経験を有する。当法律事務所に入所する以前は、IBMで知的財産権担当の企業内弁護士を務めていた。IBMでは、IBMのグローバル・ネットワーク・テレコミュニケーション会社や、IBMの完全子会社であるソフトウェア会社数社のIP担当企業内弁護士を兼務した。また、コンピュータシステム、半導体チップ、回路事業の分野ではIBMの法務責任者を務めたほか、IBMが締結する数々の特許ライセンス契約の交渉を担当した。

IBM入社前は、米海軍研究所 (Naval Research Laboratory) IP担当主任弁護士として、電子回路、半導体デバイス、光通信、新素材とコーティング分野を担当した。また、米国特許商標庁の特許審査官として、変調式送信システム、ラジオおよびテレビ分野を担当した。

リーダーシップ

連邦裁判所に提起される多数の特許訴訟で、特許法に関する専門家として意見を求められてきた。 State Street Bank事件では、連邦巡回区控訴裁判所に対して米国情報技術工業協議会  (Information Technology Industry Council) が提出した、ソフトウェアに対する特許権取得可能性に関する法廷意見書 (amicus brief) を中心となって執筆した。米国やその他の国々における知的財産権に関して論文を多数執筆し、講演も頻繁に行っている。

米国法曹協会 (ABA) では、コンピュータプログラム委員会や情報検索問題担当委員会 (Computer Programs and Information Retrieval Committees) の委員長を務め、ABA7部会(情報分野担当)の部会長も務めた。通商政策における知的財産権についての産業機能別諮問員会 (Industry Functional Advisory Committee on Intellectual Property Rights for Trade Policy Matters) (IFAC-3) のメンバーを務めたほか、ジュネーブのベルン議定書専門家委員会に情報技術産業審議会の代表者 (Information Technology Industry Council Delegate) として派遣された。

イリノイ大学卒業(理学学士号(電気工学専攻))。同大学ではエドモンド・ジェームズ記念奨学生。カソリック大学(コロンブス)ロースクール卒業(法学博士号)。

資格

コロンビア特別区、ニューヨーク州およびバージニア州の弁護士資格を有する。米国特許商標庁、連邦請求裁判所および連邦控訴裁判所連邦巡回区裁判所において弁論を行う資格を有する。

Thought Leadership

William has been called as an expert witness on patent law in numerous patent litigations in the federal courts. He was principal author for the amicus brief filed by the Information Technology Industry Council on software patentability in the State Street Bank appeal before the Federal Circuit Court of Appeals. William has also been a frequent author and lecturer on intellectual property issues in the U.S. and abroad.
