Senior Counsel

Michael Ryan is a skilled litigator with significant experience representing clients in prosecuting and defending restrictive covenants, trade secret theft claims, discrimination and retaliation claims, and wage-and-hour matters. He also regularly counsels employers on a wide range of employment matters, including unfair competition and trade secret laws, hiring and firing decisions, EEO and FLSA matters, enforcement of personnel policies, leave issues, accommodations, drug-testing laws, safety regulations, and governmental investigations.

Michael enjoys partnering with clients of all sizes, from multinational corporations to local business and executives. He has particular experience counseling employers and litigating cases involving oil and gas services and production, industrial health care, banking, security, safety, chemical, service, and retail. He also frequently presents at seminars and conducts trainings on various employment topics, including EEO matters and internal and governmental investigations.

Prior to earning his law degree, Michael served as a judicial intern for the Hon. Hilda G. Tagle, U.S. District Court Judge for the Southern District of Texas-Brownsville Division. He also worked in-house as a compliance and employment law clerk for an oilfield services company in Houston.

Representative Experience

Trade Secrets & Injunctive Relief

  • Represented an industrial distribution services company in Virginia federal court in a trade secrets misappropriation matter. Obtained a temporary restraining order and achieved a favorable settlement that included full remediation of the misappropriated information.
  • Represented a facilities services company in Texas state court in a dispute involving unfair competition and restrictive covenant violations. Successfully obtained a temporary restraining order and temporary injunction and secured a favorable settlement.
  • Defended oil and gas executives in a Texas state court dispute involving alleged misappropriation of trade secrets. Established Texas precedent on appeal concerning the scope of preemption under the Texas Uniform Trade Secrets Act and obtained favorable settlement.
  • Defended a health-tech AI company in Texas state court in a trade secret misappropriation and unfair competition matter. Successfully defended against obtaining injunctive relief or enforcement of restrictive covenants.
  • Successfully defended and obtained a walk away settlement for an industrial manufacturing company and a sales employee in Texas state court concerning alleged unfair competition and misappropriation of trade secrets.
  • Represented an industrial and consumer products manufacturing company in Washington federal court in a trade secret misappropriation and unfair competition matter. Obtained a temporary restraining order, preliminary injunction, and favorable settlement, including remediation of misappropriated information.
  • Represented a pharmaceutical manufacturer in Texas state court in a trade secret misappropriation matter. Obtained a temporary restraining order, temporary injunction, and remediation of misappropriated information.
  • Represented an industrial gas manufacturer in Texas state and federal court in a trade secret misappropriation and unfair competition matter. Obtained a temporary restraining order, temporary injunction, and dismissal of bad-faith bankruptcy petition, resulting in favorable permanent injunction and settlement.
  • Represented an IT services corporation and several employees in New Jersey state court in an unfair competition matter. Successfully obtained summary judgment dismissing all claims, which was affirmed on appeal.
  • Represented solar services company in defense of unfair competition claims in Utah state court. Successfully defended against claims of injunctive relief to obtain favorable settlement terms.

Wage-and-Hour

  • Represented a distribution company in an overtime lawsuit. Successfully defeated conditional certification and obtained favorable settlement.
  • Defended a healthcare system in a rest, meal break, and overtime lawsuit.
  • Defended an oil-and-gas company in an overtime lawsuit. Successfully limited the class during conditional certification and obtained favorable settlement.
  • Represented an oilfield services company in multiple wage-and-hour overtime and misclassification litigations.
  • Represented multiple public and private companies in Colorado federal court concerning misclassification and overtime claims.

Discrimination Litigation

  • Defended an oilfield services company in multiple discrimination lawsuits in various state and federal courts. Successfully obtained summary judgment.
  • Represented a national financial institution in defending a multi-plaintiff discrimination arbitration. Obtained a final award denying all relief.
  • Defended an oil and gas company in a multi-plaintiff litigation in Texas federal court.
  • Defended a healthcare company in a discrimination and retaliation lawsuit in Colorado state court.

  • Conducted internal corporate investigations and trade secret audits for multiple public and private corporations concerning matters of state and federal discrimination, wage-and-hour, and trade secret laws.
