Jonathan Lasken

Jonathan Lasken represents clients in high-stakes antitrust litigation, government investigations, and merger challenges. He draws on more than 15 years of experience in government and private practice, including senior leadership roles at the U.S. Department of Justice (DOJ) and the Federal Trade Commission (FTC), as well as first-chair trial experience in major antitrust litigation. Jonathan counsels companies on a variety of competition issues, including alleged monopolization, merger review, competitor collaborations, commercial agreements, and other complex competition matters. His work spans a wide range of industries, such as technology, health care, consumer products, energy, and defense.

Before joining Foley, Jonathan served as assistant chief of the DOJ Antitrust Division’s Anti-Monopoly and Collusion Enforcement Section when the section brought major enforcement matters, including the Apple monopolization litigation, the Google Ad Tech monopolization case, and the Agri Stats information sharing matter. He previously served as senior litigation counsel at the Antitrust Division and as senior trial counsel in the Office of the Director of the FTC’s Bureau of Competition, helping craft policy and litigation strategy in cutting-edge merger and conduct matters related to technology, health care, and private equity. Earlier in his career, he was an attorney in the DOJ Antitrust Division’s Appellate Section, where he led antitrust appeals on behalf of the United States.

Jonathan’s experience spans investigations, trials, and appeals. As lead counsel for the agencies in some of the government’s most significant antitrust matters, he developed case strategy, oversaw investigations, managed complex litigation, and coordinated with federal, state, and international competition authorities. These matters include the DOJ’s monopolization case against Apple, the FTC’s successful federal court trial challenging Hackensack Meridian Health’s proposed acquisition of Englewood Healthcare Foundation, the FTC’s challenge to Edgewell Personal Care Company’s proposed acquisition of Harry’s, and the FTC’s challenge to Lockheed Martin’s proposed acquisition of Aerojet Rocketdyne. He also played senior roles in the Google advertising technology case, the FTC’s successful trial blocking the proposed joint venture between Peabody Energy and Arch Coal, the FTC’s challenges to the Illumina/Grail and NVIDIA/Arm transactions, and multiple confidential health care investigations at both agencies.

Prior to joining the government, Jonathan practiced at an international law firm, where he represented clients in government and class-action antitrust litigation and counseled clients on a wide variety of antitrust issues. He also clerked for Chief Judge William T. Moore, Jr., of the U.S. District Court for the Southern District of Georgia.

  • Served as lead counsel in the FTC’s challenge to Lockheed Martin’s proposed acquisition of Aerojet Rocketdyne.*
  • Served on the DOJ team in litigation involving Google’s advertising technology business.*
  • Served on the FTC trial team in litigation involving the proposed combination of Peabody Energy and Arch Coal.*
  • Led litigation preparation and helped supervise a confidential vertical merger challenge involving health care markets.*
  • Represented the FTC in proceedings involving Illumina’s acquisition of Grail.*
  • Served as lead counsel in the FTC’s challenge to Procter & Gamble’s proposed acquisition of Billie.*
  • Led litigation preparation for the FTC’s challenge to HeidelbergCement AG’s proposed acquisition of Keystone Cement Company.*
