Foley & Lardner LLP partner Jonathan Lasken assessed potential antitrust scrutiny of DoorDash’s plan to acquire Instacart in the Law360 article, “Tech Prices, Driver Networks Hang Over DoorDash Tie-Up.”
Lasken said he is following the transaction to see how a variety of questions are answered, including around market definition. In particular, he identified as a key area to watch whether and how DoorDash’s commitment to maintaining an open platform will impact agency review.
“Promises by a platform to remain open post-merger have been made before, but have not always been sufficient to address the agencies’ competitive concerns,” Lasken added.
