Foley & Lardner LLP partner Jeffrey Greene and associate Grace Fucci authored the New York Law Journal article, “The Virtual Fitting Room,” exploring the increased litigation for biometrics data policy violations surrounding the rise of virtual try-on programs, specifically in the fashion, apparel, and beauty industry.
The authors offer background on what virtual try-on programs are and how they use biometric data to virtually apply a product, evaluate how these programs may pose litigation risks following the passage of biometric data privacy laws in several states, discuss current virtual try-on cases, and provide guidance for companies based on existing litigation.
