Foley’s Environmental Regulation attorneys presented Continuing the Global Debate: The Latest Developments in Climate Change and Greenhouse-Gas Initiatives. Foley attorneys provided an overview and analysis of climate change dialogue and activities currently taking place in Congress, U.S. EPA, and at the state and regional levels.
Topics included:
- The latest proposals in Congress to suspend EPA’s Clean Air Act (CAA) authority to regulate GHGs from stationary sources for two years, while allowing EPA to move forward with its plans for motor vehicle GHG controls — or to prohibit EPA from moving forward with any CAA GHG regulations
- Recent announcements by EPA Administrator Lisa Jackson that EPA will greatly cut back on the scope and timing of its upcoming “tailoring” program for stationary sources — such as increasing the proposed 25,000 tons per year (TPY) limit to 75,000 or 100,000
- The status of D.C. Circuit judicial review over EPA’s CAA GHG rules and the “Endangerment Finding”
- The GHG highlights in EPA’s final CAA “Renewable Fuels Standards” that will soon be published in the Federal Register
- The status of activities in the states, regionally and individually, to respond to climate change through GHG-emission reduction initiatives and the development of climate mitigation and adaptation plans
