McLaughlin Quoted on FTC Red Flags Rule

Foley Senior Counsel Peter McLaughlin was quoted in an article that appeared on American Medical News on November 23, 2009 titled “Physicians get 4th reprieve from FTC identity theft rule.” McLaughlin discusses the delay in enforcement of the FTC’s “red flags” rule, stating that a U.S. District Court decision to block the FTC from applying the rule to attorneys could be good news for physicians. He adds that if the view of the court is that the FTC made an error and was too broad in its definition and use of the term creditor, there is a good likelihood that groups such as the health care profession would be able to make similar arguments.
