Firm Announces 24 Attorneys Promoted To Partnership.
Foley announced today that 24 of the firm’s senior counsel have been elected to partnership. This includes attorneys from the firm’s Boston, Chicago, Los Angeles, Madison, Milwaukee, Orlando, San Diego, Tallahassee and Washington, D.C. offices.
New partners in the Boston office are:
Beth J. Felder is a member of the Private Equity & Venture Capital and Transactional & Securities Practices, as well as the Emerging Technologies Industry Team. She represents companies in various development stages, structuring and negotiating technology agreements, venture capital investments, mergers, acquisitions, divestitures, strategic alliances and management compensation issues.
David W. Kantaros is a member of the Private Equity & Venture Capital and Transactional & Securities Practices and the Emerging Technologies Industry Team. He represents private equity funds as well as publicly and privately held corporations in the emerging technology and life science industries. Kantaros’ experience includes counseling high-tech companies, venture capital firms, public and private companies and investment banking firms in a variety of transactional and corporate governance matters.
New partners in the Chicago office are:
Andrea M. Augustine is a member of the Intellectual Property Litigation and Electronics Practices. She focuses on intellectual property litigation and technology transfer work and regularly counsels clients in intellectual property transactional matters. Augustine is licensed to practice before the U.S. Patent and Trademark Office and has experience in prosecuting patents in computer software and hardware.
Martin J. Bishop is a member of the General Commercial Litigation, Appellate, Intellectual Property Litigation and Media Law Practices, as well as the firm’s Entertainment & Media and Insurance Industry Teams. Bishop’s diverse experience encompasses civil litigation in the areas of intellectual property, reinsurance and insurance, securities law, trade secrets, class action defense, construction law, banking, employer/employee disputes, corporate fiduciary law and contractual disagreements.
Marshall J. Brown is a member of the Mechanical & Electromechanical Technologies, Electronics and the Trademark, Copyright & Advertising Practices. Brown focuses on general patent prosecution and counseling in mechanical, electrical and computer software arts, while his technical experience includes work with consumer products, medical devices, financial products, electrical devices and systems, networks, communication systems and computer software.
Jonathan R. Spivey is a member of the Intellectual Property Litigation Practice, where he focuses on patent litigation in the mechanical, electrical and computer software arts. Spivey served as a judicial clerk to the Honorable H. Robert Mayer, Chief Judge of the U.S. Court of Appeals for the Federal Circuit, as well as served as a patent examiner at the U.S. Patent and Trademark Office.
The new partner in the Los Angeles office is:
Elizabeth S. Elson is a member of the firm’s Health Care Industry Team, where she focuses on reimbursement and compliance issues arising under government programs such as Medicare and Medicaid. She has represented a variety of health care clients, including county health departments, health systems, hospitals, durable medical equipment suppliers and dialysis companies. Elson has helped clients implement and operate Medicaid demonstration projects and has advised clients on a range of matters related to coverage, reimbursement and fraud and abuse. She also has assisted clients with internal and government investigations involving Medicare and Medicaid billing practices and anti-kickback and physician self-referral issues.
The new partner in the Madison office is:
Jeffrey A. Simmons is a member of the Intellectual Property Litigation, Trademark, Copyright & Advertising and General Commercial Litigation Practices. He has represented clients in patent infringement cases involving a diverse range of technologies, including medical braces, fluorescent lighting, chemical compounds, chemically-treated fabric and hand tools. He also has represented clients in copyright infringement cases on topics ranging from comic books to digital music file-sharing.
New partners in the Milwaukee office are:
Mark J. Diliberti is a member of the Trademark, Copyright & Advertising Practice, as well as the firm’s Entertainment & Media Industry Team. He counsels clients on a wide range of intellectual property matters and advises clients on strategic brand development, clearance and risk assessment, global portfolio management, agreement negotiation, trademark and copyright enforcement and business transactions related to intellectual property. In addition, Diliberti has substantial experience protecting unique and distinctive features of products, such as color, shape, trade dress and copyrights.
Dana M. Lach is a member of the firm’s Finance & Financial Institutions, Public Finance Services and Health Care Finance & Restructuring Practices. She has extensive experience representing investment banks and commercial banks in health care financings and derivative transactions. Lach has served as bond and disclosure counsel, as well as counsel to underwriters, issuers and borrowers in a variety of financial matters.
Mark T. Plichta is a member of the Transactional & Securities Practice, where he practices primarily in the areas of mergers and acquisitions, securities law and general corporate business law. Plichta has handled various public offerings and private placements and numerous mergers and acquisitions. He is also a certified public accountant and a member of the Wisconsin Institute of Certified Public Accountants.
Bryan S. Schultz is a member of the Transactional & Securities and Commercial Transactions & Business Counseling Practices and the International Business Industry Team. Schultz represents both public and private companies in a variety of industries with respect to transaction and business law matters, including various types of cross-border transactions. His work focuses on acquisition and divestiture transactions, joint ventures, strategic alliances, complex commercial transactions and general corporate matters. He also has experience with private equity fund formation and portfolio company investments.
Kevin R. Schulz is a member of the Transactional & Securities and Commercial Transactions & Business Counseling Practices, as well as the firm’s International Business, Sports and Food Industry Teams. He focuses in the areas of mergers and acquisitions and general commercial law and has participated in many complex acquisition and general commercial transactions, both domestic and international. He has represented clients in various industries, including professional baseball, consumer products, industrial equipment, manufacturing and consulting.

Michael A. Okaty is a member of the firm’s Transactional & Securities, Finance & Financial Institutions and Public Finance Practices. He focuses primarily in the areas of corporate and finance law and is the immediate past chair of the firm’s Associates Committee and the founder and chair of the firm’s Senior Living & Long-Term Care Practice.
New partners in the San Diego office are:
Richard L. Moskitis is a member of the firm’s Real Estate Practice and has extensive experience in business and real estate matters, including the formation of business and investment entities, the purchase and sale of businesses, joint ventures, leasing, development, construction and property management. He also has been responsible for hundreds of real estate acquisitions, dispositions and developments, and has worked on many redevelopments.
S. Wayne Rosenbaum is a member of the Environmental Regulation Practice and the firm’s Golf & Resort Industry Team. He concentrates on a broad range of environmental issues, including permits, management systems and complex regulations. Prior to entering private practice, Rosenbaum served with the Department of the Navy, Office of General Counsel, and spent 18 years as an executive in the environmental services industry.

Robert H. Hosay is a member of the Public Affairs and Government Procurement Practice. His practice helps clients develop, acquire and manage business in the government sector. Hosay partners with clients by helping them interpret the needs and opportunities within government, assisting with all steps of the acquisition process, and counseling clients regarding contract awards and litigation of contract disputes. In addition, he assists clients who are regulated by government agencies via his administrative law experience. Prior to joining Foley, Hosay was appointed secretary of the Florida Department of Management Services by Governor Jeb Bush, and prior to that, he served as director of the Governor’s Center for Efficient Government.

Nathan A. Beaver is a member of the Public Affairs and FDA Practices, and the firm’s Food Industry and Life Sciences Industry Teams. Beaver’s practice focuses on the representation of manufacturers whose products and activities are regulated by the Food and Drug Administration and the Federal Trade Commission, with special emphasis on compliance with federal regulatory requirements for developing, manufacturing and marketing FDA-related products. He also advises clients on regulatory issues affecting prescription and over-the-counter drugs, dietary supplements, cosmetics and foods.
Rouget F. (Ric) Henschel is a member of the Chemical & Pharmaceutical Practice and the International Business and Nanotechnology Industry Teams. Henschel’s practice focuses on counseling clients in patent matters, representing clients before the U.S. Patent and Trademark Office and intellectual property litigation. He served as a judicial clerk to Judge Randall R. Rader of the U.S. Court of Appeals for the Federal Circuit.
Amy N. Kroll is a member of the Securities Litigation, Enforcement & Regulation and Transactional & Securities Practices. Her practice focuses on counseling U.S. and foreign broker-dealers and other securities market participants with regard to U.S. regulatory issues. Prior to entering private practice, Kroll served on the staff of the U.S. Securities and Exchange Commission in the Divisions of Market Regulation and Corporate Finance as counsel to Commissioner Edward H. Fleischman and as an assistant general counsel. She also was an adjunct associate professor at Washington College of Law, American University.
Erika L. Morabito is a member of the Business Reorganizations Practice. She concentrates her practice in bankruptcy, creditors’ rights, debtor reorganizations and out of court restructuring, as well as complex commercial litigation, commercial real estate and loan transactions. Morabito has extensive experience representing businesses, financial institutions, corporations, partnerships and other entities involved in commercial transactions, bankruptcy and litigation matters. She also is a member of the firm’s Recruiting Committee and one of the hiring partners in the Washington, D.C. office.
Leon Radomsky is chair of the firm’s Nanotechnology Industry Team. He also is a member of the Chemical & Pharmaceutical and Electronics Practices and the Emerging Technologies and Energy Industry Teams. He focuses on strategic client counseling and intellectual property due diligence and agreements. In addition, he has experience in all phases of U.S. and international patent portfolio development, including patent application drafting, prosecution, appeals, reissues and reexaminations, including nanotechnology, semiconductor devices and processing, materials science, solar cells and fuel cells.
Lena Robins is a member of the firm’s Health Care and Life Sciences Industry Teams, and her practice focuses on regulatory matters arising under Medicare, Medicaid and other third-party payment programs. Robins advises a variety of health care providers on a range of reimbursement matters related to coverage and payment, and regularly counsels on federal and state fraud issues. Previously, Robins served as an attorney with the Office of General Counsel at the U.S. Department of Health and Human Services.
J. Steven Rutt is vice chairman of the Nanotechnology Industry Team and a member of the firm’s Chemical & Pharmaceutical Practice. His practice focuses on technology, patent counseling, prosecution and litigation, as well as intellectual property licensing and agreements, clearance opinions, trade secrets and trademarks. Rutt also focuses on coordinating the delivery of all aspects of intellectual property legal services to emerging companies and in representing them in their agreement negotiations.
