Partner Christopher Swift was interviewed on Fox News about former White House national security advisor Michael Flynn’s potential legal exposure stemming from his failure to timely register his consulting firm under an obscure federal statute known as the Foreign Agents Registration Act, or FARA, which requires anybody receiving money from and advocating on behalf of a foreign government to register periodically with the Department of Justice. Swift said FARA violations are one of the ways the U.S. government has for pursuing espionage-like charges against somebody without having to disclose secret information necessary to bring more serious espionage charges. He also said that special counsel Robert Mueller could be using the threat of FARA charges as leverage against Flynn to get him to testify about things he might know about the Trump campaign’s involvement with the Russians.
