Foley & Lardner LLP Partner Donald Schroeder was quoted in a Law360 Employment Authority article, “4 Times Big-Dollar Discrimination Verdicts Got Slashed,” about recent examples of judges slicing multimillion-dollar discrimination awards.
Schroeder noted that high punitive damages are something that judges scrutinize closely during post-trial proceedings in employment cases. He says, “In most cases, judges will exercise their discretion to reduce amounts that don’t have any rational, factual basis in the evidence.”
