Gregory Husisian Shares Insight on US Trade Court Tariff Ruling
Foley & Lardner LLP partner Gregory Husisian was quoted in Logistics Management’s article, “CIT Court Rules White House’s 10% Tariffs Not Lawful,” exploring the recent U.S. Court of International Trade decision striking down the administration’s tariffs imposed under Section 122.
“This ruling is not surprising — Section 122 is clearly aimed at balance-of-payments situations and is not intended to be a general tariff authority to support worldwide special tariffs,” Husisian explained. “This ruling has a high chance of being upheld on appeal. The real question is with regard to the scope of relief, which only gives relief to certain plaintiffs.”
A “rush to the courthouse” is expected, as importers seek refunds in a move that mirrors prior legal challenges to the IEEPA tariffs, Husisian concludes.
