Jeff Kopp Examines ADA Risks in HR Software and Workplace Technology
Foley & Lardner LLP partner Jeff Kopp was quoted in the Lexology article, “When does HR software create an ADA problem for US employers?” examining Americans with Disabilities Act (ADA) compliance issues related to HR software and other workplace platforms.
Addressing the growing use of these tools, Kopp emphasized that ADA accessibility concerns extend beyond an employee’s core job duties, stating, “the platform is part of the employer’s workplace.”
He noted that “accessibility should be evaluated with the same rigor as cybersecurity and data privacy,” urging employers to proactively test, audit, and maintain digital tools for accessibility. Kopp also underscored the need for clear processes to manage accommodation requests.
Turning to third-party HR technology, he warned, “the biggest mistake employers make is treating accessibility as solely a vendor issue.” Kopp concluded, “The earlier employers identify and address accessibility barriers, the more likely they are to avoid both employee frustration and potential ADA claims.”
