Joseph Swanson Offers Guidance on Cybersecurity Compliance for Government Contractors

Foley & Lardner LLP partner Joseph Swanson is quoted in the Cybersecurity and AI Law Report’s article, “LOGZONE Marks a First in FCA Cyber Enforcement,” analyzing a DOJ settlement involving alleged cybersecurity compliance failures by defense contractor LOGZONE under the False Claims Act.

Swanson advised government contractors to conduct a privileged internal investigation if potential deficiencies are identified. He cautioned that, if privilege is not maintained, investigative materials “could provide regulators or plaintiffs’ attorneys with a roadmap to the underlying issues and remediation efforts.”

Emphasizing the importance of strong cybersecurity compliance, Swanson stated, “A good compliance program exists in reality, not just on paper.” Looking ahead, he said, “We can expect continued enforcement activity in this space.”
