Gretchen P. Mahoney

Associate

Gretchen Mahoney focuses her practice on health care law, and she has represented long term care facilities, durable medical equipment suppliers, independent diagnostic testing facilities, pharmacies, and health systems on a range of health care regulatory, transactional, and compliance issues. She has experience in analysis of federal statutes and regulations, including the federal Anti-Kickback statute, the Stark Law, HIPAA, and the Affordable Care Act, and state laws pertaining to various types of health care providers. Her practice also includes government audits and investigations, administrative appeals, and operational matters like drafting contracts and compliance policies.

Prior to joining Foley, Gretchen served as an extern for a nonprofit with a mission of conserving wetland habitats and wildlife. She also worked as a health care associate in the Dallas office of an international law firm.

Medicare: Prescriptions Now May Be Used to Support Medical Necessity of Durable Medical Equipment

On September 26, 2024, the Centers for Medicare & Medicaid Services’ Durable Medical Equipment (DME) Medicare Administrative Contractors, Noridian Healthcare Solutions, LLC and CGS Administrators, LLC, revised their Policy Article A55426 - Standard Documentation Requirements for All Claims Submitted to DME MACs regarding documentation that constitutes a patient’s “medical record” for purposes of demonstrating medical necessity and justifying payment for covered DME items.
