Foley Releases 2026 State AG Election Report and Interactive Map on Key Races and Enforcement Trends
New resources provide a business-focused assessment of AG races to help businesses monitor enforcement trends and post-election planning considerations
Foley & Lardner LLP released today its 2026 State Attorneys General Election Report, a special report examining why the upcoming attorneys general (AG) races matter and how this election cycle may affect the state enforcement, regulatory, and litigation landscape for businesses across the country. In light of the 33 attorneys general elections (30 states, Washington, D.C., Guam, and the Northern Mariana Islands) in November 2026 there will be, at a minimum, 11 new attorneys general in January 2027.
Foley also launched its Interactive 2026 AG Election Map, a companion tool that offers an ongoing state-by-state view of election timing, incumbency status, open-seat races, business impacts, and sector-specific considerations as campaigns develop and offices begin to signal post-election priorities.
State AGs have become central players in the modern regulatory and enforcement environment. They investigate business practices, bring consumer protection and antitrust actions, review health care transactions, challenge federal rules and statutes, defend state laws, and frequently coordinate with one another through multistate litigation and investigations. In many instances, the practical impact of state AG activity extends far beyond state borders, particularly for companies operating across multiple jurisdictions or in highly regulated sectors – including energy and infrastructure, health care and life sciences, innovative technology, and manufacturing.
“This report and map together explain why the 2026 AG elections deserve careful attention from businesses. The key issue for many companies is not simply who wins these races, but how the individuals leading these offices choose to exercise broad enforcement authority, whether they join or lead multistate coalitions, and how they signal priorities during the transition into 2027,” said Ed Burbach, co-chair of Foley’s State Attorneys General Practice. “Foley’s resources are intended to help businesses better understand which races merit close monitoring and anticipate trends and changes in legal risk and enforcement priorities.”
The report provides a practical overview of the election landscape, including the races to watch, potential shifts in enforcement priorities, and the policy and litigation trends most likely to shape AG activity. It also outlines steps companies can take now to assess state-level exposure, strengthen compliance readiness, and prepare for changes in the legal and regulatory environment in 2027 and beyond.
The 2026 State AG election cycle has important implications for companies navigating an increasingly complex state regulatory and enforcement landscape. Businesses should approach these races with a clear view of their state exposure, a disciplined focus on high-impact offices, and a readiness to respond to post-election enforcement developments.
