Serwin suggests that healthcare providers that house electronic data off-site through information technology vendors consider establishing a right to court intervention in the contract to force the turnover of data. He notes that having a right to appeal to a third-party can be an important fail-safe in the event that a healthcare information technology vendor goes out of business or breaks a contract over a dispute.
