International Security Breach Survey Released by Foley and Eversheds
Survey Provides Comprehensive Summary of United States and International Security Breach Laws.
Foley announced today that the International Association of Privacy Professionals (IAPP) revealed the International Security Breach Notification Survey at its Data Protection and Privacy Workshop in Madrid, Spain last week. The survey was developed through a collaborative effort between Foley and the international law firm Eversheds LLP.
Considered to be the most comprehensive summary to date, the survey provides in-depth coverage of all major aspects of U.S. and International security breach laws. Organized by region, the survey indicates where laws and standards have been established as they relate to particular categories. These categories include: notice requirements; timing of disclosure; form of disclosure; entities that maintain data; existing policies; exemptions from disclosure; damages/enforcement; and preemption.
“This guide is a tremendous resource for privacy practitioners as well as attorneys and executives who want to learn more about security breach standards and how to manage today’s most challenging data protection issues and risks,” said Andrew Serwin, founding chair of Foley’s Privacy, Security & Information Management Practice. “With evolving technology and business models, companies are operating in more jurisdictions with privacy and security issues of critical importance. Asconcern over the ever-increasing collection of sensitive information grows, this guide can help navigate the complex terrain of privacy and data security laws.”
“This survey marks a departure from other privacy studies because it combines all privacy concerns in the U.S. and globally into a single, comprehensive guide,” said Paula Barrett, partner and head of Eversheds’ Data Protection Group. “It has truly been a global undertaking to explore the legal landscape of security breaches and we are excited to share in the IAPP’s mission to advance education on privacy management issues.”
The IAPP’s Data Protection and Privacy Workshop was held in conjunction with the 31st International Conference of Data Protection and Privacy Commissioners. A line up of data protection and privacy experts was assembled for a series of panels on today’s most relevant data protection issues and solutions for managing operational challenges and risks in the complex and rapidly evolving global marketplace.
