Carrie Hoffman Analyzes FAA Proposal to Preempt State Flight Crew Break Requirements

Foley & Lardner LLP partner Carrie Hoffman analyzed the Federal Aviation Administration’s (FAA) proposed rule preempting state meal and rest break requirements for flight attendants in the Law360 article, “FAA Rule On Flight Attendant Breaks Would Bypass Courts.”
Hoffman noted that federal regulations already limit the length of flight attendants’ shifts, typically to 14 hours and, in some circumstances, up to 20 hours. “That should take care of the ultimate purpose behind meal and rest breaks, which is to give employees a break,” she added.
Complying with state break requirements while in flight “just seems an impossible thing to comply with,” Hoffman said.
