Brandon Posivak focuses his practice on commercial litigation, representing corporations in complex commercial disputes in state and federal courts. Brandon has experience in a wide variety of practice areas, including breach of contract, franchise disputes, commercial real estate, data privacy, consumer protection, strict products liability, construction, landlord/tenant, and sports & entertainment.

He has experience across all stages of litigation, including drafting briefs, propounding and responding to discovery, taking and defending depositions, working and retaining experts, and appearing at hearings in both state and federal court. Brandon has successfully argued an anti-SLAPP motion with a subsequent successful motion for attorneys’ fees and motion for sanctions in Los Angeles County Superior Court, authored a successful arbitration brief defending Carvana in a consumer protection arbitration before JAMS, and drafted and argued multiple successful demurrers and motions to dismiss among other achievements.

Brandon draws on his prior experience as a legal extern for Austin FC in its first season as an MLS expansion team, where he worked closely with the Chief Legal Counsel on a range of contractual matters as well as protecting the Club’s intellectual property. His work included drafting and revising sponsorship agreements, player contracts, vendor agreements, stadium leases, waivers, and releases; conducting trademark research on the USPTO database and preparing cease-and-desist letters; and reviewing and analyzing insurance documentation for the Club. This background broadens his perspective and informs his practical, business-oriented approach to litigation.

Brandon was selected as a Super Lawyers Rising Star for 2026 and also received a Pro Bono Award for representing families in four separate adoptions of young children at Edelman Children’s Court in Monterrey Park, CA and authoring two appellate briefs on behalf of veterans seeking disability benefits from the VA.

Brandon is based in the Los Angeles office and is a member of the firm’s Commercial Litigation Practice Group.
