Kinal Mahesh Patel is senior counsel with Foley & Lardner LLP based in the firm’s Houston office where he is a member of the Business Law Department. Kinal advises health care, life sciences and insurance companies of all sizes as they navigate regulatory reforms and industry trends.

Kinal’s practice blends regulatory and transactional activities. It ranges from implementing strategic acquisitions and relationships, managing large-scale physician alignment strategies and developing innovative governance structures, integration-oriented policies and procedures, to advising clients facing pending and suspected compliance issues and government enforcement actions.

His regulatory practice focuses on regulatory, compliance, licensing and managed care arrangements. He has extensive experience assisting clients with structuring shared-risk arrangements, developing and utilizing innovative payment methodologies and compliance with applicable federal and state law. He also has experience handling pharmacy regulatory matters.

Kinal’s transactional practice focuses on mergers and acquisitions, joint ventures and strategic alliances in the health care and related industries.

Before joining Foley, Kinal was a senior associate at a full-service global law firm in Columbus, Ohio. Previously, Kinal was a legal fellow and staff attorney with a nonprofit multi-hospital system in Texas where he worked with corporate and clinical leadership in a range of matters such as system integration efforts, policy and procedure development and physician contracting including medical directorships and employment and recruitment agreements.

Representative Experience

  • Advising on the sale of outpatient clinics to a publicly traded healthcare organization
  • Advising on the sale of multiple physician office locations and ambulatory surgery centers to a publicly traded healthcare organization
  • Providing counsel in the private equity investment in a large physician group, including establishing an insurance intermediary
  • Advising on the private equity recapitalization of a DME manufacturer and supplier
  • Advising on the sale of medical marijuana cultivation, processing and dispensing businesses to a similar enterprise
  • Assisting in the establishment of new ACOs and CINs, and advising current ACOs and CINs on governance, membership and payer contracting
  • Advising hospitals and other providers on billing compliance, licensure and fraud waste and abuse laws
  • Advising national substance abuse centers and laboratories on fraud waste and abuse laws, including EKRA compliance
  • Advising health insurers on Medicare Advantage and Part D compliance, payer disputes and Medicaid managed care procurements
  • Advising an insurtech firm on startup health insurance operations and network development
  • Advising a national insurer on network development for a new pet insurance line
